*Introduction *: My name is "Wyatt Who Dances With Jelly Fish" and please call me Wyatt. I want to thank you all for your time and attention in this matter. It is commendable that NH has a tool to redress wrongful conduct of the few attorneys that cross that line. As part of my personal background, I have only a high school degree. I live alone. My vehicle is 18 years old. I rent a mobile home that is only 552 square feet. I am mentally disabled. I am indigent and my only income is SSDI. The good news is that I haven't lived in my car, or motels or homeless shelters in 5 years and counting. I am pathetic, I know, but even the pathetic have rights. As to my income level having me indigent, that qualifies me under the guidelines of Constitutional law and precedence of case law, that an attorney be provided to me at no cost in a criminal matter at all stages of criminal proceedings. The necessity of having an attorney in criminal proceedings, as well as at critical stages of criminal proceedings, enhances the fairness of the playing field and the credibility of our justice system in criminal matters. The right of an attorney or an appointed attorney for no charge because of my indigence is a fact of law that is incontrovertible. The office of the NHPD is assigned to represent ALL indigents in NH criminal matters, which is also incontrovertible. NHPD gets its authority pursuant to the New Hampshire Constitution and Supreme Court Rule 51, the Supreme Court of New Hampshire (according to my research).
Consider this a complaint against former NHPD former Managing Attorney, of the Concord Office, Jacki Smith. Additionally, I am filing another complaint against Attorney Christopher Keating, former Executive Director of the NHPD Board of Directors. Regard my complaints as infractions by Smith and Keating that violate the NEW HAMPSHIRE RULES OF PROFESSIONAL CONDUCT. I also believe that Smith and Keating conspired in sharing information about my case to make their own case in closing my case (see enclosure Keating letter 4/23/12). I believe they acted jointly in refusing me legal representation in a criminal matter by ultimately closing my case. The overall misconduct has both parties violating my Constitutional right to counsel as afforded me in the Constitution. I hope I can convince you of their misconduct.
