The MSHP says a driver from Sparta died in a rollover crash between two vehicles on U.S. 60 on Thursday afternoon. Troopers arrested the other driver, a woman from Mansfield, on suspicion of driving while impaired and involuntary manslaughter.

Troopers said a 2002 Cadillac Escalade driven by TC, 67, ran into the back of a 1995 Toyota 4Runner driven by MD, 68. The 4Runner went off the highway and overturned. MD died at the scene. TC refused medical treatment at the scene.

Troopers said neither driver was wearing a seat belt. By law, TC was tested to see if she was driving impaired. That test is what led to her arrest; formal charges will be up to the WC prosecuting attorney.

The crash happened shortly after 1 p.m. at Highway PP in XXX. Both vehicles were eastbound. Troopers said FPD assisted with the investigation, which included a Highway Patrol accident reconstruction team.

A judge released her from jail on her own recognizance. Her next hearing is scheduled for April 4. If she’s convicted, she could face a prison sentence up to seven years.


By my state law, this is why she is being charged with it being “involuntary” manslaughter:

First degree involuntary manslaughter is recklessly causing the death of another person or criminally negligently causing a person’s death while operating a vehicle or boat in an intoxicated condition.

Penalty

First degree involuntary manslaughter can be considered a Class B or C felony, depending on who has died and under what circumstances. The penalty range for Class B felonies is 5-15 years in prison and for Class Cs it is up to 7 years in prison and a fine up to $5,000.


A Class C Felony here falls under the same category of possessing a controlled substance.

This woman KILLED someone. Even if she didn’t mean it, she made the choices to get in the car DRUNK at ONE IN THE AFTERNOON and DRIVE.

And here’s where my LEO shit kicks in.

She should be charged with VEHICULAR MANSLAUGHTER.


0 to 15 years

Class C felony: with death to any person ––Not more than 7 years and/or not
more than $5,000.

Class B felony: Death to any person not a passenger, to two or more persons, or
while BAC is at least 0.18 ––Not less than 5 years or more than 15 years.


But I guess her BAC was too low to make it a Class B and if she was ROR then she probably didn’t have any priors.

From her mugshot, she looks like she got pretty fucked up too. At least she didn’t DIE.

And from what I read, she probably with be on probation, sentence served and not serve any time.

Disgusting.
